doesn't say and we will get to that a little later. i will recognize the gentlewoman from california, miss eshoo for five minute. thank you. i hope we will have another round because there are a lot of questions that need to be asked. i am troubled by the claims of the public safety spectrum act is all about revenue raising. the last time i checked this is the energy and commerce committee, not the budget committee. having said that, i think we did a good job to bring about a balance, to bring about the dollars that would fund the public safety network, that we would produce dollars for deficit reduction, but again, this is the energy and commerce committee, in section 309 of the communications act explicitly prohibits the fcc from basing its auction rules predominately on the revenue that would be generated and during the bipartisan negotiations on this bill compromise was reached to allow unlicensed services to operate in the guard bands that would be created as part of the band plan which would not be auctioned. the cbo looked at the proposal that became law and concluded that the

criminal cases, corporate -- on the culture war cases justice kennedy always seemed very much a california republican, a completely different instinct than justice scalia. i remember that reading of those opinions and was such a stark divide because kennedy spoke about the importance -- giving respect and dignity to gays and lesbians, their relationship to deserve the same respect and dignity as other relationships. it was such a sympathetic portrayal and so in line with what you said, the notion of the importance of relationships for gay couples. this is not a sex case. this is a case about relationships. after refinished, justice scalia cut through the air with that strong dissent, he did make a point that don't be fooled by what anyone tells you, this is going to be about marriage, same-sex marriage. to that extent justice scalia's prediction has turned out to be largely correct in the years since then. >> quite possibly, he was, certainly you will see what the court does with a marriage case if one comes forward and takes a marriage case which would have discretion to decide about. he

product. they're actually going to hold me accountable for enjoying a year at stanford, california. so my penance is to do some research, and it could be a lot of key strategic issues. what i came to two months ago driving across country with two dogs, two kids, cars, u-haul, trying to find a place to live was, you know, i'm really passionate about the future of afghanistan and pakistan. it matters. so let me do some research on. that lots of issues involved with that. but specifically, what are some of the course of action, if you will, for force structure and mission sets in afghanistan after the combat mission with nato and isaf ends in 2014. and by strange coincidence, our secretary this morning, secretary panetta, put out some, i think three tiers of missions for afghanistan. some of those are from the nato conferences in chicago in may. primarily talked about counterterrorism and our training mission. the two things, i guess, changed to. those are security force assistance missions. right now we're focusing on securing the population. that's going to shift. it's shifting now,

only route that has a possibility of being high speed is california. we have two california members we are going to hear from and we will go into details about california's progress but having visited out there, it does only service about 100 mile stretch and mostly in a rural area without transportation interconnections that we need in mobile systems, we are serving major population centers but we will talk about plans and concerned about some of the direction of what is going on in california, plans to connect los angeles, san francisco bay area which are also traveling the reports we have on that. our intention today is really to try to work in a positive fashion to make sure high speed rail occurs in the united states. i tell people in florida, in my district and around the country that our number one goal should be, as you may know, amtrak bones, the government people own, have an interest in 600 miles of track between washington d.c. our nation's capital, philadelphia, new york city, boston, the most congested corridor in the united states of america, that is the only 600 miles t

between bakersfield and fresno, california where there are very few people, their contention is long-term connected in population centers in san francisco and los angeles, but it will be a long time before that is accomplished. right now we do have the connectivity we need to, the population, and we also have the only corridor, 430 some mile corridor almost entirely unknown by amtrak, the american people and the taxpayers. that is opposed to the rest of amtrak service, 20,000 miles of service, long-distance, inner-city service, on which amtrak runs on private freight rail that is maintained and paid for on a lease basis to the private sector, and we in fact again bones this corridor and we have also highlighted -- i took the chairmanship in october of 2010, the summary of the title is the federal government must stop sitting on its assets. the first part deals with gsa and we have taken on gsa and some of the idle buildings that sat vacant. was a few minutes ago to continue the effort to get empty buildings fill. if you read through this report it also talks about the northeast corri

case heading to spring court is the a case out of california, this much more a challenge to that of the equal protection clause allows states to ban same-sex marriage. it is very much like loving v. virginia. are these states allow to be a same-sex marriage? potomac case, defense of marriage act case is a lot easier, legally and politically for the supreme court because it only applies in states better to have same-sex marriage. they are not in the same same-sex marriage on other states. i actually think they'll take potomac case and declare it unconstitutional because it is really manifest the unjust. the government has a very hard time explaining why the government needs to do this. what interest is served by penalizing married couples who happen to be of the same that. the proposition 8 case is a much more dicey proposition because of the case goes up in his car form, and there a race they could merit, but it basically is massive 44 states that don't have same-sex marriage start allowing them. that would be politically incendiary. imagine telling mississippi and alabama and texas
